Q. How do I know if I can make a claim?

Q. How much might my claim be worth?

The amount of compensation depends on a number of factors and every case is different.  Factors include the extent of your injuries, loss of income, your losses as a result of the accident and whether you were partly to blame.

Q. How long will it take before my case is settled?

Most cases are settled in a matter of months although some are settled in weeks.  A few, very complicated, cases can take a year or more.  The sooner you take action the better.

Q. Will I have to make a payment to use the service?

No. Our solicitors bear all the costs until the case is settled.  When they win, they claim everything back from the losing party.  If the solicitors lose, insurance will cover the costs.

Q. How is the cost of my claim funded?

Our solicitors have access to insurance to fund claims.  They delay their costs until the claim is settled and then recover them from your opponent. If your case is lost our solicitors will meet the cost of any policy premium, and that policy will cover the opponent's legal costs.  Our solicitors will bear their own legal costs and expenses. If you win, you will receive 100% of the compensation.

Q. Will I have to go to court?

No insurer wants to waste time and money in court defending a case where they are going to have to pay out.  The facts about who was at fault in any given case are usually fairly clear. More than 90% of cases are settled without going to court.

Q. What is the time limitation period for making a claim?

For most personal injury cases, there is a time limit within which any claim must be brought. This is known as the limitation period. For those over the age of eighteen, this period is three years from the date of the accident, for children the three year period begins on the date of their eighteenth birthday.

In every case, it is always best to seek legal advice at the earliest opportunity, when events are still fresh in your mind and information is easily available. Pursuing your case may be more difficult if the accident occurred a long time ago. Your lawyer will also need a certain amount of time to compile the necessary evidence in order to begin proceedings, so it is important not to leave it too late. In every case, medical evidence will be required. Detailed expert evidence is often also required in disease cases to show that the condition suffered was caused by exposure to a particular substance.

The limitation period for criminal assault cases is two years and is not flexible under any circumstances.
